This Acceptable Use Policy (“AUP”) governs the use of the ClubHub platform, including all associated websites created on it (each a “Subsite”). This AUP applies to all users of the platform, including Subsite Admins (our “Customers” or “Clubs”) and their “End-Users” (the members and visitors of a Subsite).
As a user of the Platform, you are prohibited from using the service in any way that:
- Violates any applicable South African or international laws.
- Is fraudulent, deceptive, or misleading.
- Harms, or threatens to harm, the security, integrity, or performance of the ClubHub network.
- Infringes on the rights of others.
Violation of this AUP may result in the immediate suspension or termination of your account or Subsite, with or without notice. The (Subsite Admin) is responsible for any violations of this AUP by their End-Users.
1. Prohibited Content
You may not upload, post, display, or distribute any content that:
- Is illegal under South African law, including (but not limited to) content that constitutes hate speech (as defined by the Promotion of Equality and Prevention of Unfair Discrimination Act), defamation, or incites violence or criminal activity.
- Is fraudulent, promotes “get rich quick” schemes, or is deceptive.
- Infringes on the intellectual property rights (copyright, trademark) of any third party.
- Is sexually explicit, pornographic, or depicts non-consensual sexual acts.
- Contains or promotes extreme violence.
- Promotes the sale or distribution of illegal substances or prescription drugs without a license.
2. Prohibited Actions
You may not use the Platform to:
- Send Spam: Send any form of unsolicited bulk email or messages (spam) in violation of the Electronic Communications and Transactions Act (ECTA).
- Compromise Security: Attempt to gain unauthorised access to any part of the Platform, server, or another user’s Subsite. This includes scanning for vulnerabilities, password mining, or running any form of malware, virus, or spyware.
- Infringe on Privacy: Collect or use any personal information in a way that violates POPIA or the privacy of an End-User.
- Deceive or Impersonate: Impersonate any person or entity, including a ClubHub official, or falsely state your affiliation with any person or entity.
3. Resource and Network Abuse
You may not engage in any activity that threatens the stability and performance of the ClubHub multisite network. This includes:
- Using excessive server resources (CPU, bandwidth) that negatively impact other Subsites.
- Running any script or process that is designed to be “always on” or consume disproportionate resources.
- Executing any form of network attack, such as a Denial of Service (DoS) attack.
- Hosting or acting as a relay for any form of malicious activity.
4. Enforcement and Violations
We (420 Twig PTY LTD T/A Clubhub) reserve the right, but not the obligation, to monitor all Subsites for compliance with this AUP.
If we become aware of a violation, we may take any of the following actions in our sole discretion:
- Issue a written warning to the Subsite Admin.
- Remove the offending content immediately, with or without notice.
- Suspend the Subsite or specific user accounts.
- Terminate the Subsite and the Subsite Admin’s account permanently, in accordance with our Platform Terms of Service.
- Report any illegal activities to the relevant South African authorities (e.g., the South African Police Service).
